Rules for using this website and general conditions applicable to the contracting of CCX Company services.

CCX Company · CNPJ 24.329.191/0001-06 · São Paulo, Brazil · Updated on April 2, 2026

Overview

1. Introduction

Welcome to the CCX Company website ("CCX", "we", "our"), a private law entity registered with CNPJ under number 24.329.191/0001-06, headquartered in São Paulo/SP, specializing in technology consulting, software development, digital commerce, integrations, data, artificial intelligence and proprietary SaaS products.

These Terms and Conditions ("Terms") govern (a) the access and use of this website and (b) the general conditions applicable to the contracting of CCX services. They are complemented by specific contractual instruments for each project — Commercial Proposal, Master Service Agreement (MSA), Statement of Work (SOW), Data Processing Agreement (DPA) and service orders.

These Terms are governed by Brazilian law, including Law No. 12.965/2014 (Internet Civil Rights Framework), Law No. 13.709/2018 (LGPD), Law No. 8.078/1990 (Consumer Protection Code), Law No. 10.406/2002 (Civil Code), Law No. 9.610/1998 (Copyright Law), Law No. 9.279/1996 (Industrial Property Law), Law No. 12.846/2013 (Anti-Corruption Law) and other applicable regulations.

2. Definitions

For purposes of these Terms, the following definitions apply:

  • Website: CCX institutional website at ccxcompany.co and its subdomains.
  • Visitor: any person who accesses the Website.
  • Client: natural or legal person who contracts CCX services through a contractual instrument (Proposal, MSA, SOW or service order).
  • Services: consulting, dedicated squads, software development, implementation and evolution of platforms (VTEX, Salesforce Commerce, SAP Commerce, Shopify Plus), migrations, integrations (SAP, Protheus, MuleSoft), Data & BI, AI for Business, mobile apps, web apps and proprietary products (CCX Messages, NexLog OS).
  • Deliverables: artifacts, source code, documentation, dashboards, models and other products generated from the contracted Services.
  • Personal Data: any information related to an identified or identifiable natural person, pursuant to the LGPD.
  • DPA: Data Processing Agreement, which governs CCX's role as a data processor for the Client.
  • SOW: Statement of Work — document that details scope, deliverables, timelines, team and values of a specific project.
  • AMS: Application Management Services — maintenance and continuous evolution services post go-live.

3. Acceptance and effectiveness

3.1. The use of the Website constitutes tacit acceptance of these Terms by the Visitor. The contracting of Services, in turn, depends on the signature of a specific contractual instrument by the parties, which prevails over these Terms in case of conflict.

3.2. These Terms are effective for an indefinite period. CCX may modify them at any time, with effect from their publication on the Website. Substantial modifications will be communicated prominently.

4. Eligibility

4.1. The contracting of Services is intended for legally established entities and natural persons over 18 years of age, fully capable under civil law.

4.2. The representative who signs any instrument on behalf of the Client declares that they have the authority to do so, being responsible for the truthfulness of this declaration.

Contractual hierarchy

In case of conflict: (1) specific SOW prevails over (2) MSA/Master Agreement, which prevails over (3) Commercial Proposal, which prevails over (4) these Terms. These Terms apply supplementarily to the extent not contradicted by the higher-level instruments.

1. Technology consulting

1.1. CCX provides strategic technology consulting services, including diagnosis, solution architecture, platform selection, roadmap planning, technical governance, performance assessment and digital transformation.

2.3. CCX is responsible for the selection, replacement and management of its professionals. There is no employment relationship or direct subordination between the Client and squad members.

2.4. Professional replacement: CCX may replace squad members for operational reasons, ensuring adequate knowledge transfer. The Client may request replacement for justified reasons, observing the transition timeline agreed in the SOW.

2.5. Ownership of code produced by squads is regulated in the SOW — by default, source code developed under contract is assigned to the Client after full payment of installments.

3. Engagement rules

3.2. CCX is not responsible for unavailability, price changes, contract changes or feature discontinuation made by platform vendors.

4. Platform migrations

4.2. Typical migration scope includes: source data audit, mapping design, development of extractors and loaders, sample validation, reconciliation and scheduled cutover.

4.3. CCX is not responsible for data inconsistencies existing in the source platform — the diagnosis conducted in Discovery will identify the databases requiring prior cleanup.

Cutover and transition windows

Go-live is executed in a window agreed with the Client, preferably during a period of lower traffic. CCX provides documented rollback plan. During Hypercare, critical changes are prioritized under reinforced SLA as specified in the SOW.

3.2. Excluded from assignment: (a) pre-existing components, CCX proprietary libraries (CCX Core Libraries), internal frameworks and reference knowledge used in execution; (b) open-source software under their respective licenses; (c) licensed third-party components. For pre-existing components, the Client receives a non-exclusive, perpetual and non-transferable license.

3.3. Know-how and methodologies developed by CCX (playbooks, templates, accelerators) remain the exclusive property of CCX and may be reused in other projects.

4. Testing and quality

CCX Messages

1. The CCX Messages service

CCX Messages is CCX's service for sending communications via email, SMS and WhatsApp on behalf of client companies ("Company"), through official integrations — including the WhatsApp Business Platform (operated by Meta), telecom carriers and email providers. The service is contracted through a commercial proposal, agreement or specific work order.

2. Data roles and responsibilities

In the operation of CCX Messages, the Company is the controller of recipients' personal data and CCX acts as a processor, handling data exclusively under the Company's instructions and under the applicable data processing agreement (DPA).

3. Client Company obligations

  • Obtain and keep records of valid recipient consent (opt-in) before any sending, where required by law or by channel policies;
  • Honor unsubscribe requests (opt-out) immediately on every channel;
  • Send lawful content only: spam, phishing, fraud, misleading content, harassment, illegal content or restricted categories without legal authorization are prohibited;

6. Availability and third-party dependencies

Message delivery depends on third-party platforms (Meta, telecom carriers, email providers) and is subject to their rules, windows and technical limits. CCX applies best delivery efforts but does not guarantee receipt, timing or reading, nor is it liable for outages caused by such third parties.

Transparency about Meta

WhatsApp and the WhatsApp Business Platform are Meta products and trademarks. CCX uses the official integrations made available by Meta and is not affiliated with, sponsored or endorsed by Meta. Use of the WhatsApp channel is also subject to Meta's own terms and policies.
